Welcome to Le MAGA édit. The terms « we », « us » and « our » refer to Le MAGA édit, a sole trader business operated by Melissa Chahir Jarmouni. Le MAGA édit operates this shop and this website in order to offer you, as a customer, a personalised shopping experience (the « Services »). Le MAGA édit uses the Shopify platform, which allows us to provide you with the Services.

These Terms of Use (« ToU »), together with the policies referred to in them, describe your rights and responsibilities when you use the Services. By visiting, interacting with or using our Services, you agree to be bound by these ToU and by our Privacy Policy.

ARTICLE 1 — ACCESS AND ORDERS

To use the Services, you may be asked to provide certain information (email address, billing, delivery). You warrant that this information is accurate and complete. When you place an order, you are making an offer to buy ; it is only considered accepted once we have confirmed it in writing.

ARTICLE 2 — OUR PRODUCTS AND PRICES

We do everything we can to present our products faithfully. Colours or appearance may differ slightly depending on your screen. Displayed prices include VAT and are shown in euros. We reserve the right to correct any pricing or description error at any time.

ARTICLE 3 — SHIPPING AND DELIVERY

Delivery times are set out in our Shipping Policy. They are given as an indication ; we accept no liability for delays caused by the carrier or by circumstances beyond our control.

ARTICLE 4 — RIGHT OF WITHDRAWAL AND RETURNS

In accordance with Belgian and European law, you have 14 days from receipt of your order to exercise your right of withdrawal, without having to give a reason. The full conditions are set out in our Refund Policy.

ARTICLE 5 — INTELLECTUAL PROPERTY

The Services, including texts, images, logos, visuals and their layout, are the exclusive property of Le MAGA édit or of its licensors and are protected by intellectual property law. Any reproduction or exploitation without prior written permission is prohibited.

ARTICLE 6 — RELATIONSHIP WITH SHOPIFY

Le MAGA édit is powered by Shopify. Every sale is made directly between you and Le MAGA édit. Shopify is not responsible for any aspect of that transaction.

ARTICLE 7 — PERSONAL DATA

Your personal information is processed in accordance with our Privacy Policy and with the General Data Protection Regulation (GDPR).

ARTICLE 8 — PROHIBITED USES

It is forbidden to use the Services for unlawful or fraudulent purposes, or in any way that infringes the rights of third parties.

ARTICLE 9 — ERRORS AND INACCURACIES

The Services may occasionally contain errors (price, description, availability). We reserve the right to correct them and to cancel any order concerned, with a full refund.

ARTICLE 10 — LIMITATION OF LIABILITY

Within the limits allowed by Belgian law, Le MAGA édit cannot be held liable for indirect damage arising from the use of the Services.

ARTICLE 12 — GOVERNING LAW

These ToU are governed by Belgian law. Any dispute falls within the exclusive jurisdiction of the courts of the judicial district of Brussels, without prejudice to your mandatory rights as a consumer.

We may update these ToU at any time by publishing the revised version on this page.
